1. Customer Obligations

a) The quantities and dimensions indicated in the contractual documents are approximate and it is the customer’s responsibility to confirm the shop drawings prior to fabrication.

b) The parties agree that the quote is offered pursuant to the design concept and is subject to change according to the modifications requested in writing by the customer.

c) The customer must provide Yurpal with all the plans and specifications for the project and all the documentation necessary for Yurpal to prepare shop drawings.

d) The parties agree that Yurpal may not start the order before having received the approval of the shop drawings and that Yurpal is not responsible for any delays relating to the approval of the shop drawings or the delays necessary to correct and resubmit new versions of the shop drawings.

2. Delivery
a) The parties agree that the delivery time is approximate and subject to change depending on the time of receipt of the purchase order, approval of the drawings, and production times.
b) The customer becomes responsible for all the risks associated with the loss, total or partial, as soon as he takes possession of the goods ordered. The customer is deemed to have taken possession of the goods ordered as soon as a delivery is made and accepted.
c) The customer is responsible for unloading the truck with their own equipment.
d) When taking possession of the product, the customer must inspect the product and notify Yurpal in writing of any apparent defects or damage and record them in writing on the delivery note from the carrier. Failing to do so, the customer is deemed to have waived all its remedies for defects or apparent damage.
e) Yurpal cannot be held to respect approximate delivery times if he is prevented from fulfilling his obligation due to circumstances over which he has no control.

3. Installation
a) Installation is excluded
b) Any installation relating to the goods is the sole responsibility of the customer and any damage caused by the installation will be the sole responsibility of the customer. 

4. Warranty

a) The parties agree that if the customer makes any modifications to the products, the warranty is invalid. 

5. Storage costs 

b) The parties agree that if Yurpal must store the goods ordered for more than thirty (30) days, a monthly storage fee of 25% of the value of the order is payable by the customer.

6. Return and cancellation fees
a) The parties agree that no return or cancellation can be made for custom orders or for products that have been painted.
b) If the order was to be canceled by the customer following the sending of shop drawings by Yurpal, the parties agree that Yurpal reserves the right to charge 15% of the total agreed-upon amount. 

7. Responsibility limitation
a) Except in the presence of a gross or intentional fault, Yurpal is in no way liable to the customer for material damage caused in the performance of this quote, which includes in part but is not limited to damage caused by delay in the preparation of drawings, or a delay in the manufacture or delivery of the goods ordered.

8. General conditions
a) By signing this quote, the customer accepts all the terms and conditions mentioned herein.
b) The budgetary prices in this quote are valid for a period of 5 business days.
